The Australian Building and Construction Commission last year individually prosecuted 96 Western Australian workers from Leighton-Kumagai for taking part in unlawful industrial action. Workers found to have participated in a strike to reinstate a sacked union worker could face fines up to twenty two thousand dollars for breaching the Howard governments Building and Construction Industry Improvement Act. The case against the workers was later dismissed by justice Finn and ordered that the court costs incurred by the unions be paid.
